This article was produced through the exploratory qualitative research method, it aims to conceptualize and exemplify obstetric violence in its essence, demonstrating clearly and objectively some acts that give rise to obstetric violence in the time lapse of childbirth, postpartum, including abortion. As well as a historical approach to the birth and all the transformations that took place after the establishment of the technocratic model. It is also presented as if there is criminal responsibility for obstetric violence, based on the premise that there is no specific criminal type that punishes the perpetrators of obstetric violence, but it is possible to classify the acts of violence in various criminal types. These are: injury, ill-treatment, threat, illegal constraint, bodily harm and not infrequently to attempted murder, all listed in the Brazilian Penal Code.
