MARIANA FERRER LAW SEX CRIMES AND ADVANCES IN PROTECTING WOMEN'S RIGHTS

In several cases, intolerance involving the guilt of the victim in Brazil is significant, as many consider that the sexual crime would have occurred as a result of the woman's behavior, questioning her clothes, her way of acting and even the place during the criminal act. Since it is essential to provide greater protection to victims of sexual crimes, evaluating issues related to sexual dignity and the consequences generated by rape, the advent of law nº 14.425/21 becomes fundamental, generating relevant protective changes in legislation. For that, a bibliographic research is carried out. It starts from the hypothesis that law nº 14.425/21 is based on the case of the digital influencer Mariana Ferrer, who occupied the position of victim of the crime of rape of a vulnerable person in a judicial process, since she was under the influence of alcohol. during sexual intercourse. In the course of the process, the defendant's lawyer exposed photos of the influencer humiliating her in order to turn the situation around in favor of her client. In this way, the need to regulate some situations related to the protection of victims and witnesses in the course of actions is highlighted, especially regarding the restraint of the practice of acts that offend the dignity of those and establishing an increase in the penalty of the crime of coercion.
