RESPONSIBILITY OF CHILDREN: AN ANALYSIS ABOUT INVERSE AFFECTIVE ABANDONMENT

This research proposes to analyze the importance of affection in family relationships and the consequences caused by inverse affective abandonment. Although there is no specific and exhaustive law on the subject, the Federal Constitution of 1988 and the Elderly Statute itself maintain measures to protect the elderly. The issue related to the possibility of moral damage due to emotional abandonment is still very controversial, but lately it has been admitted in the doctrines and jurisprudence of our Courts. The objective of this work is to discuss the possibility of indemnification, the result of inverse affective abandonment. Address the role of the elderly in society, the importance of care within the family, and propose the characteristics and assumptions of civil responsibility. This article was conceived according to a deductive method, using the techniques of bibliographic research, legislation and articles. The work in question seeks to analyze the legal concept on the subject and the possibility of civil liability for abandonment, in order to prevent and minimize the damage caused to the elderly by family abandonment.
