EUTHANASIA A SYSTEMATIC STUDY OF BRAZILIAN LEGISLATION

Euthanasia is a topic widely discussed in the field of Law, understanding that it is both the right to life and the right to individual freedom. In addition, the study is also present in the medico-legal context. In this sense, analyzing the authors that deal with the theme, making a comparison and observing the impasses of the discussion. Thus, it was defined as a general objective: to analyze what the current national legislation establishes about the practice of euthanasia and as a specific objective to verify if the right to life overrides the right to human dignity; Describe the historical context of Euthanasia and demonstrate aspects of euthanasia from Brazilian law. For this, the methodology used is descriptive and qualitative bibliography, in addition to a content analysis based on the communication between the chosen authors. It can be concluded that the subject is controversial and must be careful seeking, through the debate, a plausible solution, since the law to be voted on in the Senate chamber, entitled as "new Brazilian penal code", which reinforces the prohibition the practice of euthanasia and provide for the practice of “orthothanasia”, as an exclusion of illegality typified in article 122, § 2 of the bill to be voted on in the future.
