Abstract

This article focuses on Bills nº 399/2015 and nº 399-A/2015, which deal with the regulation of Cannabis sativa for medicinal use. In this bias, it analyzes the problem that involves the legalization of local cultivation with the same purpose and the delay in the judgment by the Legislative and Judiciary spheres. He resorted to a literature review to deepen the subject, highlighting the main scientific advances on the beneficial effects of the use of substrates obtained from this plant and the respective results in the treatment of various symptoms and diseases. Emphasizes emblematic cases in Brazilian law, which claim permission to plant, cultivate and extract the substance cannabidiol with inhibition of tetrahydrocannabiodiol (THC), in specific laboratories. It concludes that if this cultivation is legalized, it can minimize the exploitation of this imported raw material, reducing government spending on health problems generated by chronic diseases and even contribute to stimulating new scientific studies on other medicinal plants.
