POSNERIAN CONTRIBUTIONS TO LAW AND LITERATURE, A POSSIBLE DEBATE WITH DWORKIN

The proposed review has as its theme the relationship that can be created between Law and Literature in Richard Posner and the debates that can be made with Ronald Dworkin, given the many confusions of finding that Posner does not accept the movement for its criticisms, it is necessary to demystify the propositions. Therefore, the theoretical assumptions of Law and Literature will be explained; A possible dialogue between Law and Literature in Posner is presented, given its importance in law and its demystifying criticisms about the Law and Literature movement, and theoretical formulations by Richard Posner, Ronald Dworkin in which they bring relevant theoretical assumptions to the theme are examined. Thus, it is concluded that it is necessary to demystify the negative relationship that Posner has with the Law and Literature movement, in addition to bringing a debate to perhaps improve the movement, elucidating its absurdities and its gaps.
