Abstract

In Brazil, the socialization of school-age children is usually promoted in public or private educational institutions, as parents, as well as the Government and society in general, expect children and adolescents to acquire a variety of opportunities and knowledge outside the family and believe that the social skills of individuals in childhood are obtained primarily at school. However, other countries, especially the more developed ones, when comparing students who study at home to children who attend conventional schools, suggest that students in homeschooling (home schooling) have better friendships and better relationships with their parents and other adults, in addition to to be as happy, optimistic and satisfied with their lives as those who study at an educational institution. In the case of autistic children, whose main symptoms are aggression, difficulty in social interaction, repetitive behavior and intolerance to loud noises such as those that are usually common at school, home schooling is a good option, as it increases the possibility of them acquiring knowledge, social sense and responsibility, as well as ensuring that she is able to exhibit less emotional turmoil and problematic behavior than her peers. Thus, the present study focuses on answering whether the law should define how children with Autism Spectrum Disorder (ASD) should really be forced to attend regular and/or special educational institutions, addressing autism, presenting particularities, needs and main treatments for this pathology, highlighting the benefits of a teaching model whose law respects adaptations to the needs of children with ASD. To achieve this objective, a bibliographic research was carried out, seeking to mention the laws that address the rights and duties of disabled people and specifically of the autistic public; present symptoms, causes and treatments for autism; and exposing homeschooling as a legal possibility for the autistic child.
