Abstract

The objective of the present work was to carry out a bibliographical research and jurisprudential analysis on the theme of multiparentality between socio-affective affiliation and the reflexes in succession law. Society has always had the traditional family model of: father, mother and children. However, with the evolution of the Family law, new family concepts emerged, such as multiparentality. These new concepts opened horizons and were no longer only relationships based on blood ties, but also socio-affective ties, a thesis that was validated by the Federal Supreme Court. At the time of the child's registration there could be only the name of the biological parents and currently with this great evolution, can also be inserted the names of the affective father or mother. However, multiparenting does not exempt any of the parents from their duties, everyone will have obligations to the child and healthy coexistence between those involved is extremely important, so that the children can have a good quality of life. Affective recognition must be thought out and done responsibly, always looking out for the well-being of the child, as it is irrevocable. This work aims to demonstrate the legal effects, benefits and consequences that can arise due to multiparentality and affective bonds. Another objective of the work will be to demonstrate that socio-affective children who have multiparental bonds have a legitimate right in relation to succession, right to food, custody, inheritance and others. The Federal Constitution, in its article 227, §6, provides that there can be no distinction between children.
