Educational assistance is constituted and guaranteed by law, it aims at respect and the dignity of the human person. Above all, the right to education, which is not just for free people, but for all citizens. It is a bibliographic and documentary research. In the normative documents that deal with education for those deprived of liberty, it is sought to explain the rights of these people and in the theoretical contribution the ideas of the authors who discuss the theme will be used and observed: Silva and Araújo (2013); Munoz (2010). The main results indicate that the laws guarantee the rights of the prison population, but in practice, education in the prison system needs public actions to validate schooling and other rights with a focus on resocialization and social reintegration of the convict.
