CRISIS OF GUARANTEE FOR THE BAD USE OF ACTIVISM

Abstract

 This article aims to present introductory notions about the theories of activism and guaranteeism, critically analyzing the way each theory interprets and acts before the legal system. This paper will deductively expose the guarantee theory, which is a defense mechanism regarding the relationship between the state and the individual. In the end, there is a conclusive debate on how guaranteeism can be most effective in the face of activism, having in Guaranza the purpose of providing rights, legal certainty and guarantees, foundations not found in activism.
