Abstract

This study aims to recognize the importance of consensus in inter vivos relationships expressed by inheritance. A deductive approach was employed based on a literature review for conducting an exploratory and documental research using the supporting principles of legal norms. The relevance and originality of the legal discussion are essential for increasing the awareness of the population regarding the importance of using the extrajudicial inventory, considering the speed and economy of this act. This extrajudicial process in the transfer of assets has a positive result and the use of family harmony as a hereditary vocation of assets is widely beneficial. The appreciation of consent as the primacy of societal evolution theoretically and methodologically contribute to legal solutions, thus reflecting the Droit de Saisine and hereditary transmission of assets.
