TEAR GAS SPRAY AND ITS CONTRIBUTIONS TO THE POLICING DOCTRINE OF THE MILITARY POLICE OF PARÁ: A TECHNICAL, LEGAL, OPERATIONAL, AND JURISPRUDENTIAL ANALYSIS

Tear gas spray is used by Military Police forces as a less-lethal weapon, requiring technical, legal, and operational knowledge for its proper use. This study analyzed the technical, legal, operational, and jurisprudential aspects related to its use, with emphasis on the Military Police of the State of Pará. The research adopted a qualitative, descriptive, and exploratory approach based on bibliographic and documentary sources. Legislation, technical standards, institutional manuals, operational procedures, scientific literature, and judicial decisions were analyzed. The results showed that, although classified as a less-lethal weapon, tear gas spray may pose health risks and requires compliance with the principles of legality, necessity, and proportionality. It is concluded that expanding this topic in policing manuals may contribute to the technical improvement of police officers and greater legal certainty in police interventions.
