COMBATING BIOPIRACY: PRESERVING MATERIAL AND CULTURAL HERITAGE AND PROTECTING THE RIGHTS OF LOCAL COMMUNITIES IN THE AMAZONAS

Based on the analysis of articles, books, journals, and news reports, this study was developed using the bibliographic research method, aiming to investigate the impacts of biopiracy on biodiversity and the rights of local communities in the Amazonas, as well as to propose solutions to mitigate its consequences. Biopiracy results in the reduction of biodiversity and the transgression of the rights of local populations. The existence of legislative gaps, coupled with the lack of intelligent land occupation and state oversight in highly coveted areas, contributes to the deficit in effective protection against a series of crimes related to this practice. There have been advancements in international legislation on the matter with the signing of the International Intellectual Property Treaty in May 2024. In this context, the adoption of stricter policies for protection, the defense of social equity, and access to information is fundamental to establishing progress capable of reducing the damage caused by these crimes against indigenous and traditional populations.
