CRIMES AGAINST PERMANENT PRESERVATION AREAS FROM THE PERSPECTIVE OF THE NEW BRAZILIAN FOREST CODE

Introduction: Permanent Preservation Areas (APPs) have a relevant environmental function in protecting natural resources and maintaining ecological balance. However, constant environmental infractions and changes promoted by the New Brazilian Forest Code have generated debates about the effectiveness of the legislation in preserving these areas. Objective: The objective of this research is to analyze the changes promoted by the New Forest Code, especially regarding the protection of APPs, discussing the effectiveness of environmental legislation in the face of constant violations against flora and natural resources. Materials and Methods: The methodology used was based on bibliographic and documentary research, through the analysis of legislation, scientific articles, doctrines, and content available in electronic media related to the topic. Results: The results show that the changes promoted by the New Forest Code have intensified debates about the flexibilization of environmental regulations, especially due to the reduction of protection limits and the expansion of possibilities for economic use in previously protected areas. It was also found that environmental crimes related to Permanent Preservation Areas (APPs) remain frequent, driven by economic interests and insufficient state oversight. The discussion demonstrates that, although Brazilian environmental legislation presents relevant protection mechanisms, challenges remain regarding its effective applicability and the balance between economic development and environmental preservation. Conclusion: It is concluded that the protection of APPs is essential to guarantee environmental sustainability, requiring the adoption of more effective public policies, rigorous oversight, and social awareness to ensure the preservation of natural resources and the fulfillment of the socio-environmental function of property.
