FAKE NEWS AND DISINFORMATION IN ELECTIONS: THE INFLUENCE OF ARTIFICIAL INTELLIGENCE AND DEEPFAKES ON THE ELECTORAL PROCESS

Digital transformation in the 21st century has intensified the use of artificial intelligence (AI) in the production and dissemination of information, directly impacting the electoral process. This study aims to analyze the capacity of the Brazilian legal system to address the challenges arising from the use of AI and deepfakes in spreading fake news during elections. The research adopts a qualitative, bibliographic, and documentary approach, based on doctrine, legislation, and studies by the Superior Electoral Court. It is observed that although there are regulatory mechanisms, such as the Internet Civil Framework and TSE resolutions, there are still gaps in specific regulation regarding advanced technologies in the electoral context. The results indicate that disinformation spread through AI poses a threat to the integrity of elections and voter decision-making. It is concluded that updating the legal framework and promoting coordinated actions among the State, digital platforms, and society are essential to protect democracy in the face of technological advancements.
