PRISON CHAOS AS A CONSEQUENCE OF STATE FAILURES IN THE SOCIAL SPHERE

This study addresses the issue of prison chaos as a consequence of the lack of social protection on the part of the Brazilian State. The objective is to explain how the ineffectiveness in promoting effective public measures aimed at the population in situations of social vulnerability contributes to the increase in the prison population, making it impossible to have basic structural conditions for adequate sentence fulfillment and the resocialization of inmates. To this end, current legislation, especially that dealing with individual, collective, and group rights, is related to recent data on population poverty, the conditions of children and adolescents, and the Brazilian prison system, clearly demonstrating the connection between social vulnerability, insufficient or absent assistance from the State, and prison chaos.
