ARTIFICIAL INTELLIGENCE IN THE BRAZILIAN JUDICIARY AND ITS IMPACTS ON HUMAN DIGNITY

Abstract

This study investigates the impact of artificial intelligence use on the Brazilian Judiciary. To this end, it analyzes the meaning of human dignity and seeks to understand, in a basic way for legal professionals, what artificial intelligence represents. It also examines what Digital Law and Digital Governance are, including AI governance. From there, it addresses existing artificial intelligence initiatives and tools within the institution, highlighting the benefits and risks associated with the judicial use of these technologies. It utilizes research already undertaken on the subject, such as that developed by the Center for Innovation, Administration and Research of the Judiciary of the Getúlio Vargas Foundation (CIAPJ-FGV) under the coordination of Minister Luís Felipe Salomão and Federal Judge Caroline Somesom Tauk, and the Report on the Use of Generative AI in the Judiciary produced by the CNJ (2024). In identifying the advantages and disadvantages of integrating AI into the Justice system, this study investigates how this impacts the human dignity of those subject to the law and, at times, of the institution's own members. Ethical guidelines and best practices for the judicial use of AI systems are presented, extracted from international and national texts. Based on these texts, specific guidelines are outlined for preventing or mitigating each risk examined. Furthermore, a conformity analysis is conducted between the suggested guidelines and the governance carried out by the CNJ (National Council of Justice), based on CNJ Resolution 615/2025. Thus, the research seeks to answer the central question: how does the use of artificial intelligence in the Judiciary relate to human dignity, and what is its potential impact on this dignity? Is the governance proposed and exercised by the CNJ sufficient to contain threats to this fundamental right? Finally, the expectation with the production of this scientific research is to contribute to studies on the subject in the academic field and to promote the broadening of the institutional vision regarding the use of AI systems in the Judiciary.
