The antisocial disorder known as psychopathy has become a major social and legal problem, given the gaps in the legal system and the State’s lack of preparation in dealing with these cases, especially with regard to the reintegration of these individuals into society. This article set out to analyze the influence of psychopathy on criminal recidivism, taking as its focus the “Maníaco da Cantareira” case. The central issue is to examine how psychopathy directly influences criminal recidivism. Furthermore, the general objective is to analyze the influence of psychopathy on criminal recidivism, based on the study of the case of Ademir Oliveira Rosário, the “Maníaco da Cantareira”, and to identify the failures of the Brazilian penal system with regard to risk assessment and the monitoring of ex-prisoners with severe personality disorders. This research was carried out using the deductive method, through indirect observation, with the examination of general themes and a bibliographic review. At the end of the study, it was understood that psychopaths should not be treated by the Brazilian penal system as ordinary inmates, given their particular condition. It is necessary to have specific laws capable of effectively managing these offenders, in order to achieve the best possible outcome both for them and for the society that is at the mercy of their actions.
