Abstract

This article analyzes the vulnerability of motorcyclists in Manaus traffic from the perspective of the fundamental right to life and physical integrity. Based on data from DETRAN-AM, FVS-AM, SAMU, and IBGE, a significant increase in fatal accidents and serious injuries is observed, highlighting structural failures, lack of enforcement, and state omission. The research, of a qualitative and exploratory nature, is based on the constitutional foundations of articles 1, III, and 5, caput, of the Federal Constitution, and article 1 of the Brazilian Traffic Code (Law No. 9.503/1997), relating them to the objective responsibility of the State for omission (art. 37, §6, CF/88). It is found that the lack of effective public policies and the precariousness of Manaus' urban infrastructure compromise the right to life, constituting a violation of human dignity. It is concluded that the protection of motorcyclists must be understood as an essential legal and human duty, requiring integrated action between traffic authorities and continuous preventive policies.
