Abstract

This study analyzes the impacts of digital exclusion on the effectiveness of access to justice in Brazil. Using a qualitative and exploratory approach, based on bibliographic, documental, and case law analysis, it seeks to understand how socioeconomic, regional, educational, and technological factors influence citizens' ability to participate in electronic procedural acts. The findings reveal that the lack of robust public policies for digital inclusion deepens historical inequalities and compromises the realization of fundamental rights, leading to effects such as denial of defense and limited adversarial participation. Furthermore, landmark rulings from the Superior Court of Justice (STJ), the Regional Labor Court of the 2nd Region (TRT-2), and the Court of Justice of the Federal District (TJDFT) were identified, recognizing the need to adapt procedural practices to the technological vulnerability of parties. It concludes that effective access to justice in the digital era requires the integration of inclusive policies, investments in infrastructure, assistive technologies, and a cooperative stance by the Judiciary.
