PUBLIC RECORDS AND TECHNOLOGICAL INNOVATIONS: BLOCKCHAIN AS A TOOL FOR LEGAL DISINTERMEDIATION

This article examines the legal possibilities of blockchain technology as a tool for disintermediation in Brazilian public records, focusing on its ability to promote transparency, security, and efficiency. Using a qualitative and exploratory approach, a bibliographic research was conducted, analyzing scientific articles published between 2020 and 2025, selected from the CAPES Periodicals Portal with the terms “Blockchain,” “Public Records,” “Notary,” “Notarial,” and “Registry.” Eight articles were analyzed through critical reading and hermeneutic analysis to identify benefits, challenges, and regulatory perspectives. The results indicate that blockchain, through smart contracts and distributed ledgers, can complement notaries, reducing costs and processing times, as supported by Law No. 14,382/2022 and CNJ Ordinance No. 89/2019. However, the lack of specific regulation, conflicts with the General Data Protection Law, and digital exclusion pose significant barriers. The study concludes that blockchain has the potential to modernize public records, but its implementation requires a robust regulatory framework and inclusive policies to ensure equity and legal validity. Future empirical studies are recommended to assess the practical application of the technology in Brazilian notaries.
