LATE ADOPTION: LEGISLATIVE INFLUENCE AND UNINTENDED CONSEQUENCES OF ADOPTED CHILDREN

This scientific article addressed the subject of Late Adoption: The legislative influence and the unintended consequences of the adopted child. Late adoption refers to the adoption of children and adolescents at older ages, where it presents contexts and challenges that differ from those faced in the adoption of younger children. Thus, it identified how the legislation has been dealing with the situation over the years. Thus, the problem of this research was: "How has Brazilian legislation been dealing with cases of Late Adoption?" In view of the above, this article had the general objective of analyzing Brazilian legislation and its treatment for cases of this type of adoption as the problem occurs. The specific objectives were to describe a brief history of the late adoption process and how the legislation has changed over time; to contextualize Late Adoption and to present the legislative changes on the subject in order to mention the weaknesses and consequences of the normative changes. This study consisted of descriptive and explanatory bibliographic research, conducted using a qualitative approach, in the legal system, in the SciELO databases, Google Scholar, PUC repository, magazines, theses, books, scientific articles and websites. The research concluded that, despite being a controversial and challenging topic, Late Adoption is essential for the well-being of many children and adolescents, offering them the chance to find a home and providing transformation and renewal for all involved. Where a positive result was sought, this study may help in the debate and in improving laws, thus guaranteeing the right to family life for all, regardless of age.
