FOOD PROVISION TO ELDERLY PEOPLE IN VULNERABLE SITUATIONS

The aging of the Brazilian population has been increasing significantly in recent decades. And the elderly, who are people over sixty years of age, have some rights, including the right to food, but they often reach this age and are unable to provide for themselves. We know that the right to food directly influences the quality of life of these elderly people. Despite the various health care programs for the elderly, at the federal, state and municipal levels, much remains to be done. In this context, this study aims to address the issue of providing food to the elderly, with the aim of trying to predict the existence of a constitutional norm that has already been foreseen and ignored. The methodology used was bibliographic research and the guiding question was: What are the legal and institutional mechanisms available to ensure this right and how can the State act when the family obligation fails? From the theories researched, it can be seen that the obligation to provide alimony is based on the principle of family solidarity and the principle of human dignity. Before the legal imposition, the moral duty to provide alimony prevails under the binomial of the need of the person requesting it and the possibility of the person providing it.
