Abstract

This article find to discuss the regulation of Artificial Intelligence in Brazil through Law Project No. 2,338/2023, which is currently being processed by the National Congress. To this end, a comparative study was carried out between the Brazilian proposal and the Regulation recently approved in the European Union – EU IA Act, with a view to identifying points of convergence and divergence between the regulations. Law Project No. 2,338/23 seeks to create a regulatory environment adapted to the Brazilian reality, taking advantage of the best of the European regulation, the EU IA Act presents a more comprehensive and rigorous approach to data protection and citizens' rights. Both legislations highlight the need for a balance between technological innovation and the protection of human rights.
