CHALLENGES AND PERSPECTIVES IN THE APPLICATION OF THE PROTECTED LISTENING LAW: REVICTIMATION OF CHILDREN AND ADOLESCENTS

This article aims to analyze the challenges and perspectives in the application of the Protected Listening Law (Law nº. 13,431/2017) to prevent the revictimization of children and adolescents who are victims or witnesses of violence. Child and adolescent violence is a serious violation of human rights and requires adequate responses from the justice system and the social protection network. The research was developed through bibliographic research, addressing concepts of violence, comprehensive protection, specialized listening, special testimony and revictimization. Protected listening represents a significant advance in guaranteeing the rights of children and adolescents, seeking to ensure humane, respectful care free from revictimizing practices. However, its effective implementation faces obstacles such as insufficient training of the professionals involved, the precarious physical infrastructure in the institutions, cultural resistance within the justice and public security system and the absence of standardized protocols between municipalities and states. In addition, the difficulty of applying the law in remote and vulnerable areas is highlighted. Overcoming these challenges requires ongoing efforts to provide training, raise awareness, invest in infrastructure, and strengthen the protection network. It is concluded that the full effectiveness of Law No. 13,431/2017 is essential to ensure comprehensive protection and absolute priority for children and adolescents' rights, promoting a more humane justice system that is committed to the dignity of victims of violence. Improving institutional practices is essential to ensure that children and adolescents are heard in an ethical, safe, and respectful manner.
