Abstract

This article aims to investigate the regulatory and administrative obstacles that affect investments in offshore wind energy in Brazil, with a special focus on a draft of a proposed law presented to parliament, a Bill 576/2021. The sector has strategic potential for diversifying the Brazilian energy matrix and regional development but faces challenges due to the lack of a specific regulatory framework. This text assesses the effectiveness of Bill 576/2021 in establishing the legal certainty necessary to attract investments. The methodology combined a literature review and legislative analysis. The results indicate that the lack of a regulatory framework is the main obstacle to the development of the sector, together with legal conflicts and the complexity of administrative processes. The Bill 576/2021 represents a positive move, but its effectiveness will depend on careful implementation and harmonization with the current legal system.
