IMPACTS OF THE FEMICIDE AGGRAVATING CIRCUMSTANCE IN COMBATING VIOLENCE AGAINST WOMEN

This scientific article analyzes the impacts of the femicide aggravating circumstance in combating violence against women. The central question is: does the femicide aggravating circumstance contribute to the reduction of domestic violence against women? Using a legal-sociological bibliographic methodology, the study reveals that family violence against women is rooted in patriarchy, which sustains machismo and promotes unequal treatment between genders. It addresses the various forms of violence suffered by women, especially in the marital context, highlighting the urgent need for effective public policies to combat all forms of aggression against women. The importance of these policies is based on constitutional principles and Human Rights, which ensure the protection of gender equality. Finally, the article examines the relationship between domestic violence and the femicide aggravating circumstance, showing that both legislations complement each other to reinterpret current facts. It concludes that the femicide law acts as an instrument to confront and combat domestic violence against women, reinforcing the State’s commitment to protecting women’s rights.
