THE STATE'S INEFFICIENCY IN PROTECTING THE ENVIRONMENT: THE SHORTAGE OF MATERIAL AND HUMAN RESOURCES

This paper presents an overview of the environmental crisis in light of the dilemma of how the State is inefficient in protecting the environment, as an active agent in combating the scarcity of material and human resources necessary for the well-being of society. It discusses the origin and trajectory of the foundations of environmental law in Brazil, as well as the consequences for society and the environment resulting from the lack of physical infrastructure and human capital. In addition, it discusses the duties that the State has towards society and the environment, having the responsibility of finding a balance between man and the environment. It also analyzes the legal consequences for the State when it does not provide a healthy environment for all. The general objective of the study is to understand the role of the State in developing policies to combat environmental crimes, with the following specific objectives: To relate the right to the environment ecologically with the well-being of society; to demonstrate the duty of the State to promote public policies for environmental protection; to analyze the actions of the State of Amazonas in combating environmental crimes to confront the climate crisis. For this purpose, an exploratory methodology was used through the qualitative and quantitative method, through books, scientific articles and reports made available by institutions and programs focused on information and environmental protection to obtain minimum data that support the conclusion of the subject addressed.
