Cybercrimes have proven to be notoriously difficult to investigate and prosecute successfully. A multitude of issues in policing and criminal law related to cybercrime influence this difficulty. In view of this, this article aims to relate criminal typification in the context of cybercrime due to data theft and cloning. An integrative literature review was developed. The main steps in conducting this review were the following: developing a research question, conducting a literature search, specifying selection and evaluation methods, detailing and synthesizing the main findings on the topic. The results found in this study showed that criminal typification in the context of cybercrimes, especially those related to information theft and data cloning, reveals the need for constant updating and adaptation of the legal system in light of the dynamics of new technologies. In view of this, it is understood that there should be more studies that address the topic, due to the importance of disseminating knowledge about cybercrime in the national legal system. It is relevant to society, to the area of law and can serve as a subsidy for legislative adjustments in policies related to this issue.
