This paper addresses the legal, social, and ethical implications of using artificial intelligence to manipulate intimate images without consent. The practice of Deep Nudes exposes victims to serious violations of personality rights, such as privacy, honor, and dignity, while also highlighting gaps in legislation and challenges in holding perpetrators accountable. The study analyzes concepts like Constitutionalized Civil Law and Digital Constitutionalism, discussing the limits of freedom of expression in contrast with the protection of fundamental rights. The paper also suggests solutions based on a multidisciplinary approach, involving regulation, digital education, and self-regulation technologies, to mitigate harm and prevent further abuse. Ultimately, the paper emphasizes the need to modernize the law to keep pace with technological advancements and effectively protect victims.
