FREEDOM OF EXPRESSION: THE IMPACT OF MISOGYNY IN BRAZIL

Freedom of expression is a fundamental right guaranteed by the 1988 Federal Constitution, but its application in the digital environment presents challenges, especially in view of the dissemination of hate speech against women. The growth of social networks has expanded the reach of individual demonstrations, making public discourse more accessible, but also increasing misogynistic attacks and gender-based violence online. In this context, this article investigates how the inappropriate use of digital platforms challenges the limits of freedom of expression, analyzing the applicable laws and the effectiveness of the punishments provided for in the Brazilian legal system. The study uses a qualitative and exploratory approach, based on a bibliographic review and documentary analysis of legal norms and doctrines. The results show that, although there are legal instruments, such as the Internet Civil Rights Framework and Law 13.642/2018 (Lola Law), the application of these norms still faces challenges, especially with regard to holding offenders accountable and the effectiveness of penalties. It is concluded that the regulation of digital hate speech requires legislative improvements and greater rigor in the application of sanctions, ensuring a safer digital environment for women, without compromising freedom of expression.
