SEWAGE FEE: A QUESTIONING OF THE LEGALITY OF THE CHARGE IN LIGHT OF THE REALITY OF SERVICE PROVISION

This article addresses the analysis of the sewage tariff in Brazil, highlighting its direct impact on the quality of life of populations, especially in low-income areas. Based on a bibliographic review and documentary analysis, the study investigates how the tariff can be an instrument for improving sanitation services when applied in a fair and proportional manner, generating necessary resources for infrastructure investments. However, it also highlights the challenges and negative implications of the poor implementation of this tariff, which can result in the exclusion of a significant portion of the population, especially in poorer municipalities where the quality of the service provided is insufficient. The research emphasizes the importance of an equitable tariff model that takes into account local socioeconomic realities and suggests alternatives such as cross-subsidies and social tariffs to ensure that all citizens have access to basic sanitation. The analysis of the legal position also reflects the need for more effective regulation based on constitutional principles of social justice and equity to promote the universalization of access to essential sanitation services.
