THE EFFECTIVENESS OF THE APPLICATION OF CRIMINAL LAW IN TRAFFIC OFFENSES IN BRAZIL: ANALYSIS OF PUNITIVE AND PREVENTIVE MEASURES

Traffic safety is an ongoing challenge, especially in countries with high accident rates, such as Brazil. The Brazilian Traffic Code (CTB) establishes rules that regulate driver behavior, aiming to reduce infractions and accidents. However, the effectiveness of applying the penalties prescribed by the CTB faces significant obstacles, such as inadequate enforcement, delays in the judicial system, and a sense of impunity among drivers. This article analyzes the effectiveness of punitive and preventive measures in Brazil, investigating the relationship between legislation, enforcement, and practical outcomes in reducing infractions and accidents. The research shows that, although penalties are necessary, they are not sufficient to deter offenders, requiring more intensive enforcement and expanded educational actions. Furthermore, the study highlights the importance of public engagement and the continuity of awareness campaigns. Adapting legislation to new transportation technologies is also crucial for improving road safety. The conclusion is that a combination of punitive, preventive, and educational measures, along with efficient enforcement, is essential to reducing accidents and promoting safer traffic in Brazil.
