Abstract

The present study deals with the Clean Record Law and its consequent importance for democracy. In this way, it will be approached in the course of the text about the role of Complementary Law 135/10, or Clean Sheet Law, as it was popularly known, and the innovations referring to the system of ineligibility. The main objective of this study is to explore the theme and to point out the changes that have arisen since the publication of the Law, which is based on the concept of ineligibility and other important concepts related to the theme. Initially, it will be discussed about preliminary notions referring to the jurisdiction and the state, as well as on the Brazilian electoral jurisdiction. Next, issues related to the electoral process were discussed and followed by notes from Complementary Law 135/10. With this, it was possible to understand the role of the State and the Society in the face of the implications of this Law.
