ELECTRONIC JUDICIAL PROCESS AND DIGITAL EXCLUSION: CHALLENGES FOR GUARANTEEING ACCESS TO JUSTICE

The paper addresses the challenges posed by digital exclusion in the context of the electronic judicial process in Brazil, implemented by Law No. 11,419/2006, which aims to modernize justice through greater efficiency, agility, and accessibility. Despite the advancements, digital exclusion compromises the principle of universal access to justice, particularly affecting individuals without adequate access to technology or the necessary technical skills. The study aims to analyze the impacts of this exclusion on access to justice, highlighting the importance of inclusive strategies to mitigate inequalities and ensure that the digitization of the judicial system is widely accessible. Methodologically, a deductive approach was adopted, with exploratory research and bibliographic review, allowing for an in-depth analysis of the challenges faced by the digitally excluded and possible solutions. The results demonstrate that, although digitization has generated significant benefits such as increased speed and cost reduction, it has also exacerbated historical inequalities. Vulnerable populations, lacking access to devices, quality internet, or technical training, face barriers that limit their right to justice. It is concluded that digital inclusion is essential for the effective realization of access to justice and requires investments in technological infrastructure, population training, and the formulation of inclusive public policies. Only in this way will it be possible to transform the electronic judicial process into an effective and equitable tool, ensuring that all citizens, regardless of their socioeconomic conditions, can benefit from the modernization of the judiciary.
