Health is the greatest good desired by human beings. Throughout history, the struggle to achieve the right to access to healthcare established this right in the Magna Carta of 1988, as a social right available to all. In Brazil, access to quality public healthcare is still a constant struggle without a clear horizon. At this juncture, if health is a fundamental right available to everyone, as well as a duty of the State, why is access to health so precarious in Brazil? Based on the problem question, it is possible to create the following hypothesis: The right to health is a right guaranteed in the Federal Constitution, but public policies for access to health are still inefficient and precarious.
