Inclusive education is a topic discussed in all educational institutions today. This article addresses the topic in context with the current scenario. The objective is to give an overview of the situation based on the laws that underlie them in Brazil. As it is a basic, qualitative, exploratory research that aims to make known how the subject is happening in the environment. The research took place through a careful bibliographic review search through the digital platforms of Lilacs, Scielo and Google Scholar, of articles, books and websites, in the period from 2008 to 2024. An analysis of the fundamental aspects in the implementation, the transformations required in the scope of professional training, environmental and material resources, for effective implementation in regular school environments. It presents considerations about the “new paradigm” of school, which includes not only finding ways for the target audience to remain in schools, but which favors the guarantee of rights to school according to their needs and the social, cultural, and cognitive development of all students and become Inclusive Education in fact.
