Abstract

The Jury Court is a centuries-old institution that carries within itself the complexity and duality of popular justice, representing one of the most emblematic pillars of the Brazilian legal system. In this e-book, entitled "The (Im)partiality of the Sentencing Council in the Trial of Crimes Against Life, in Brazil", we invite the reader to take a reflective dive into impartiality and justice in the trial of intentional crimes against life.
Structured in three chapters, this work offers a comprehensive and detailed view of the subject:
The first chapter, Historical Evolution of the Jury Court
This chapter outlines the origins of the Jury Court, revealing how it was shaped by different historical and cultural contexts. From its conception to the present day, we analyze the changes and permanences that shape its essence.
The book then presents “The Jury Court Institute in Brazil.” Here, the focus is on the Brazilian context, exploring the current legislation, the specificities of the Sentencing Council, and the peculiarities of our legal system. With this, we seek to understand how the Jury Court operates in our country and the role played by its members in the search for justice. Finally, the third chapter presents “Justice in Jury Court Decisions.” This chapter discusses the delicate relationship between impartiality and subjectivity in the Sentencing Council’s decisions. With a critical approach, we analyze to what extent justice is, in fact, achieved and what are the challenges faced by this body in a system where popular participation is fundamental. Over the next few pages, the reader will find an analysis that combines theoretical research, critical reflections, and practical examples, contributing to an essential debate on the role and impartiality of the Jury Court in Brazil. This is an invitation to students, lawyers and all those interested in understanding and questioning the foundations of justice in our society.
