This paper examines false accusations of rape in Brazil, highlighting the legal and social consequences for those wrongly accused. It begins by addressing the evolution of Brazilian legislation regarding the crime of rape and analyzes the presumption of innocence, an essential principle that guarantees due process. The study also explores the motivations behind false accusations, including personal revenge, and the influence of the media and the impact of false accusations in the "court of public opinion", showing how sensationalism can undermine due process. It concludes that a balance between protecting the victim and defending the accused is essential to ensure justice.
