This article aims to provide a legal analysis and reflect on the historical legacy that leads the Brazilian penal system and the application of penalties to a process that results in the mass incarceration of the population, the criminalization of the younger and poorer layers of Brazilian society. This analysis is focused on those who survive within this system in the metropolitan area of Manaus. The occurrence of uprisings in the prisons of the capital of Amazonas is part of the scope, aiming to observe the violation of human rights within these facilities, the choice of criminality, when inside these complexes, for survival, and the administrative deficiencies that hinder the rehabilitation process of the inmates, as well as the processes and public policies aimed at combating the state's neglect of this reality.
