The research was motivated by the search for rights and accountability regarding the moral, social and psychological consequences caused by emotional abandonment. It also seeks to explore the forms of abandonment, how it should be avoided, and how it cannot be reversed once it happens. Compensation compensation, parental dissolution, unfortunately does not undo the psychological trauma and emotional damage that emotional neglect produces in personal life. These are disorders that must be monitored for life by specialists, which is another of the losses caused by abandonment. It brings the legal perspective of what family is, principles introduced in the Federal Constitution and in special legislation that guide how creation should be carried out and forms of protection for minors so that their upbringing is better. It introduces what moral damages are, and the possibility of civil liability for emotional abandonment due to moral damages, provides a legal and doctrinal opinion on how cases like this should be treated and how to identify whether it is a fact of emotional abandonment caused by the parent( a) that neglected affection towards the pubescent or if it was caused by parental alienation caused by the parent who kept the child
