Abstract

The present article aims to propose a reflection for society on the absence of a specific criminal classification for false accusations of sexual crimes and its implications for the accuser. Based on analyses of legislation, doctrine, and the media, the use of accusations of sexual crimes committed by women as an instrument of revenge, which most often occur without witnesses, will be discussed. The study employs empirical and bibliographic methods, including the analysis of real cases, seeking to clarify the importance of caution when dealing with the prison population and highlighting the need for emotional control, even in seemingly serious situations.
