This article sought to outline considerations about euthanasia, despite the complexity of the topic, the objective of the article is to demonstrate the importance of death with dignity, together with the right to life. As well as addressing concepts and characterizing the importance of the assumption in the legal system, pointing out essential information. To this end, establish a differentiation between the themes of euthanasia and orthothanasia. It discusses euthanasia in detail in the draft of the new penal code, that is, considering the right to life, as well as death with dignity. In this sense, the research was carried out using bibliographical research methodology, carried out using books, manuals and review articles, seeking, in the course of the work, to demonstrate the application of the principle of human dignity in cases of Euthanasia. Furthermore, a concrete case was exposed involving the violation of the right to the principle of human dignity, the principle of health determined in the Federal Constitution of 1988. To this end, this topic was selected, as it contains an important aspect and debates related to the latest days in the individual's life so that they are treated with dignity as stated in the Federal Constitution of 1988, for these reasons the article seeks to inquire whether there are intersections brought by the legal system, in the case of inertia to the selected topic.
