REVERSE AFFECTIVE ABANDONMENT: FAMILY AND LEGAL CHARGES

This study examines reverse emotional abandonment in the context of Brazilian law, highlighting its relevance in contemporary family dynamics. Initially, the evolution and concept of family is addressed, highlighting its essential role in the development of individuals and the construction of emotional bonds. Family law today is not limited to property issues, but also covers personal aspects, recognizing affection as a fundamental legal principle that imposes a duty of care. The absence of this care, especially in relation to the elderly, can lead to serious consequences, such as the worsening of illnesses and social isolation, making affection a legal value that demands protection. The study shows that, although there are no specific laws on reverse affective abandonment, the Federal Constitution and the Statute of the Elderly Person support civil liability in this context. The analysis reveals that responsibility for moral damages can be attributed to the lack of emotional assistance on the part of children. With the increase in the elderly population in Brazil, reverse affective abandonment becomes an urgent issue, reflecting social stigmas that make the elderly invisible. The work concludes that, although current legislation is not sufficient, there is room for new studies and legal approaches that promote the dignity of elderly people and curb harmful practices.
