THE INFLUENCE OF RELIGIOUS PRINCIPLES ON THE BRAZILIAN LEGAL SYSTEM

The influence of religious principles on judicial decisions and also the extent to which these principles, inherent to social life, interfere with the conduct and dynamics of the State is the subject of several debates and studies. It is well known that Religion and Law function in society as a means of directing social conduct, each in its own way acts on individuals in order to guide their actions and judge them when necessary. Thus, the objective of this article was to describe the influence of religious principles on the Brazilian judiciary. To this end, bibliographical research of an explanatory and theoretical nature was used as a methodology, based on the qualitative analysis of scientific articles published in the main research bases, such as Scielo and Capes, in addition to opinion articles published in magazines and reference websites in the area of Law. Issues related to blood transfusions in Jehovah's Witnesses, the use of psychographed letters as legal evidence and sabbatical keeping were listed for presentation. It was not intended to arrive at a definition of the cases, but rather to bring the debate to enrich the knowledge of the authors and readers who have access to this article.
