REDUCING THE AGE OF CRIMINAL AGE: A CRITICAL ANALYSIS

Abstract

This article aims to analyze the impact of reducing the age of criminal responsibility on the policies of Brazil's children and adolescent justice system, considering its implications on prison overcrowding, violation of juvenile offenders' rights, and overall effectiveness in reducing youth delinquency. The debate over lowering the age of criminal responsibility from 18 to 16 years old continues to enjoy broad support in Brazilian society, especially due to the frequency with which crimes committed by adolescents close to turning 18 appear in crime reports. The central question of this study is: What is the impact of reducing the age of criminal responsibility on the policies and practices of the juvenile justice system in Brazil? To answer this question, a qualitative methodology was adopted using a deductive approach. The research involved analysis of existing legislation, parliamentary debates, current public policies, and an evaluation of potential alternatives and their consequences. The results indicate that reducing the age of criminal responsibility could have several negative implications, such as increased prison overcrowding, violation of youth rights, and ineffectiveness in reducing youth delinquency. Furthermore, the measure does not appear entirely effective in reducing violence and crime in the country, necessitating consideration of more comprehensive public policies that include education, health, and social and economic support.
