PARENTAL ALIENATION AND THE CIVIL LIABILITY OF THE ALIENATOR

The study addressed the issue of civil liability in cases of parental alienation in a comprehensive and detailed manner. The article discusses the forms of parental alienation, the consequences for the children and adolescents involved, the requirements for establishing the civil liability of the alienator, the legal implications and the reparation mechanisms applicable to these situations. The article's main objective was to investigate how Brazilian legislation addresses civil liability in cases of parental alienation. To achieve these objectives, a bibliographic review was used as a methodology and, in terms of its nature, it was descriptive, with a qualitative approach. Data collection was carried out from sources such as books in printed and digital format, scientific magazines, websites, as well as legal documents relating to parental alienation, civil liability of the alienating subject and jurisprudence. The main results of the study showed that the advent of Law 12,318/2010 brought greater awareness to the damage caused by this practice and the promotion of measures that aim to protect the well-being and rights of the children and adolescents involved.
