The present study has the scope of answering the subsequent preposition: How does the thesis of the legitimate defense of honor resonate with the plot of the work “Sonata a Kreutzer”, by Leo Tolstoy and the ADPF publication nº 779? The general objective is to analyze the unconstitutionality of the thesis of legitimate defense of honor and relate it to the literary work “Sonata a Kreutzer”, by Leo Tolstoy. In the meantime, to build the debate, we essentially have studies by Dória (1994), Clements (2012), Barsted (1999) and Eluf (2021), in addition to Tolstoy's work and the criminal codes corresponding to the time frame in question, such as the Imperial Code and Domostrói. Furthermore, such information was methodologically collected through a qualitative approach, using a bibliographic review of scientific articles, legal, historical, and literary texts.
