This work addresses structural and institutional racism in the context of law enforcement in Brazil, focusing on racial profiling. The problem arises from the interaction between the black population and public security forces, particularly the military police, and how racism manifests in these interactions. The objective is to analyze specific cases that illustrate racial profiling and the shortcomings of the Brazilian judicial system, citing authors such as Silvio Almeida, Rondelli, Misse, David Luiz Barbosa de Souza, Isabella Maria Nunes Ferreirinha, Tânia Regina Raitz, Juliana Santos Botelho, and Geisa Mattos. The importance of this work lies in the need for effective anti-racist practices and the protection of fundamental rights to combat structural and institutional racism. The case of Francisco Cicero dos Santos Júnior, a black man initially convicted of drug trafficking, serves as a thread to work on the issue of racial profiling.
