CRIMINAL LIABILITY OF INDIVIDUALS WITH SCHIZOPHRENIA

The objective of this study is to examine and understand the origins and causes of mental disorders in contemporary society, investigating their association with violent crimes. Through a legal analysis, we seek to discuss the possibility of criminal liability for perpetrators who suffer from these disorders or their non-imputability for such crimes. To support this discussion, the bibliographical research method was adopted, based on the studies of Alexandre Martins Valença, Talvane Marins de Moraes, Juliana Garbayo and Marcos José Relvas Argôlo, especially in the articles “Relationship between homicides and mental disorders” and “Crime and psychiatric illness: profile of the population of a custodial hospital in Rio de Janeiro”. These studies contributed to the preparation of this work, highlighting the correlation between the increase in mental disorders in the Brazilian population and the growth in the number of prisoners suffering from these conditions.
